Travel Services Agreement

You are also responsible for respecting authority and following the guide`s instructions during a tour. You may be excluded from participation in all or part of the Tour if your condition or conduct, in our sole discretion or at the sole discretion of the Supplier, renders you unfit for the Tour or unfit for pursuit once the Tour has begun. Incapacity may include, but is not limited to, any conduct that is inappropriate or offensive, regardless of cause, or that interferes with the provision of travel services, or that may constitute danger or embarrassment. In this case, our liability is strictly limited to the reimbursement of the reimbursable expenses of an unused part of the trip. We are not responsible for the conduct of other participants towards you. If you decide not to participate in certain parts of the tour, these unused parts will not be refunded. You agree to indemnify us from any and all liability for all matters for which we disclaim all liability under this Agreement. You agree to indemnify and hold us harmless from any liability to third parties arising from your acts or omissions or omissions of your companions. All third parties involved in this Agreement shall be assigned and maintained by the Company. All travelers must have a valid passport for international travel and many countries require a validity of at least 6 months from the date of return. Some countries also require a machine-readable passport and/or available unstamped pages.

When assisting with an international travel booking, we assume that all travelers on the booking have a valid passport. If not, you must let us know. It is important to ensure that you have valid passports, visas, and return permits that meet the requirements of immigration and other government agencies. Any fines, penalties, payments, delays or expenses incurred as a result of such documents that do not meet the requirements of such authorities are your sole responsibility (except to the extent caused by our fault). In the event of a breach of the terms contained in this Agreement, the defendant has the option to terminate this Agreement. All funds you have paid to us are our property and constitute a debt due and payable to the travel service provider. You agree and acknowledge that such money will not be held in trust by us for and on your behalf, and we may hold such money in any account we deem appropriate, including with our own money and/or that of our other customers. A flight described as “direct” on your travel documents and/or itinerary is not necessarily non-stop. All departure/arrival times are indicated by the relevant airlines and are estimates only. They are subject to change due to air traffic control restrictions, weather conditions and operational requirements.

Please provide your frequent flyer membership details (or other relevant loyalty program details) when booking. Please check your loyalty program for specific membership requirements. We cannot guarantee that the travel service provider will award you points for your booking. Any discrepancies in the loyalty program relating to your reservation must be notified to us within six months of your departure date. In order to protect your employees` personal data, we maintain appropriate technical and organisational measures as set out in the Flight Centre Travel Group (“FCTG”) Data Processing Addendum, available at no.fcm.travel/trust-and-compliance. The parties agree that the terms of the FCTG Data Processing Addendum are incorporated by reference into this Agreement and form part of this Agreement as set forth herein. For the purposes of Directive (EU) 2015/2302 on package travel and related travel services and Norwegian legislation transposing this Directive, the Parties agree that this Agreement constitutes a general agreement on the provision of business travel. During the Term, we will do our best to provide you with the requested services. We sell a variety of travel-related products from different suppliers and service providers (“Suppliers”). Each provider has its own terms and conditions that apply to your specific agreements in addition to our terms and conditions, and you need to make sure you understand them. Certain software and content on our website is owned or licensed by us or our suppliers, the use of which may be subject to additional terms.

Our website referred to in this Agreement is located at www.thetravelingcompass.com. Your contract with your suppliers may allow them to cancel or change bookings. If we are your booking agent, we will ensure that you are promptly informed of any material changes as soon as we become aware of such a change, if there is time before your departure, but we will not be responsible for any changes or costs that may result. Subject to the Supplier`s terms and conditions, you will then have the choice to accept the change of arrangement, accept an offer of alternative travel arrangements if provided by the Supplier, or cancel your booked arrangements and receive all applicable refunds. We do not guarantee that refunds will be made. In cases where only one person acts on behalf of a group of passengers as part of the ticket purchase and check-in process, that person assumes responsibility for providing the terms and conditions to each passenger travelling and is responsible for providing the explanation of understanding on behalf of the group. The Group Representative or Company shall indemnify for any misunderstanding or claim arising from the failure to notify or obtain consent with respect to the Terms and Conditions or this Agreement. We reserve the right to refuse personal cheques as a means of payment. After full payment, the terms of the contract with your supplier may allow them to increase the cost of your arrangements.

If we act as a booking agent, we will send you such an increase as soon as we become aware of such an increase. If we have arranged a package, changes in transportation costs, including fuel costs, taxes, fees and exchange rates, mean that the price of your travel arrangements may change after you have paid in full. You agree to use our website or services only to make legitimate reservations or purchases and not to make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in accordance with applicable law. The Website is subject to the Terms of Use. To protect the personal data of your employees, we take appropriate technical and organizational measures. The parties agree that the terms of the Privacy Policy are incorporated by reference into this Agreement and form part of this Agreement as if set forth therein. All services provided under this Agreement (including all ancillary services such as access to the booking platform, traveller tracking and reporting) are considered instructions for processing personal data.
